This came off of the FWC website today. In addition, I was at the beach today and asked an FWC officer about this and he confirmed the following;

The latest stock assessment indicates that gag grouper in the Gulf of Mexico are overfished and undergoing overfishing. NOAA Fisheries Service recently announced an interim rule that prohibits recreational harvest of gag grouper in Gulf of Mexico federal waters until long-term management measures for gag grouper can be developed.
Harvest of Gulf gag grouper is prohibited in federal waters through May 31, 2011 and could be extended for another 186 days. However, it was the intent of the Gulf of Mexico Fishery Management Council (GMFMC), when requesting this temporary rule, that there should be a recreational harvest of gag in 2011. At its February meeting, the GMFMC discussed an interim rule that would continue the current interim gag grouper closures, but also allow for a recreational open season for gag grouper in Gulf federal waters from Sept. 16 through Nov. 15. This federal open season would be dependent on Florida adopting a consistent closed season for state waters beginning June 1.
The FWC will discuss federal consistency action at the April Commission meeting.
This closure also prohibits anyone on board a vessel for which a federal commercial or charter/headboat permit for the Gulf of Mexico Reef Fish fishery has been issued from harvesting or possessing gag grouper in state waters of the Gulf of Mexico. The interim closure does not apply to other recreational harvesters fishing for gag grouper in state waters.
At this time, Florida state waters of the Gulf of Mexico will open April 1, 2011 to the recreational harvest of gag, black, red, yellowfin, yellowmouth, rock hind and red hind grouper. However, the recreational harvest of gag grouper is still prohibited in Gulf federal waters off Florida (beyond nine nautical miles from shore). Also, persons on federally permitted for-hire reef fish vessels may not harvest or possess gag grouper in both federal and state Gulf waters (within nine nautical miles from shore).

So, you can keep grouper, including Gag. Gag only in state waters, all others are open in both state and federal

Are you guys actually catching legal sized gags in State waters? I have never been able to find any that close in. I know of people who get them but it is few and far between.

Well it says gag is open in state waters for recreational vessels, but for charter or "for hire" vessels it's stilll closed in state and federal. Am I right?

"There are legal sized gags in the bay"
I looked for them in the bay Sunday and only came up with small snapper, but you have inspired me to look harder!
