Almighty journalism gods will you ever see to forgive me I am but a lowly retired LEO working as a Mortgage Broker and know not what you know. As for going wild west I used the word reasonible, which again is not wild west. It is however the standard and the exact word used in all laws governing use of force and is the same word used in the jury instructions should you find yourself on the wrong side of this. the only thing that i took and continue to take seriously is your "Nothing could be further from the truth" statement. I probably should have written a legal brief however I assumed (bad choice) that I could paraphrase the law and simply say you can defend yourself and your stuff as long as you do it reasonibly. The very next post is "

wow, so yall think you can defend "property" with deadly force". No No No No. In case you missed it NO. You can defend propery with reasonible force. During this if the need arises to defend YOURSELF or ANOTHER with deadly force you may. HERE IS THE BIGGIE. At this point you are not defending your property you are defending yourself, and you found yourself in this crapstorm while defending your property(and you do have the right to defend your property).

Sorry this struck a nerve, I spent 20 years of my life doing this every day. Knowing when and how to use force and how to investigate how force was used. I am extremely familiar with the law and to be told I am a liar by someone who apparently googled a portion of my response pisses me off a little.
You owned this!!

not directed at you kandv. i was gonna drop it and let it lay but i'll derail hopefully just one more time. i appreciate you clearing it all up. i hope anyone that read your first post continued to read this thread and found your last. correct me if i'm wrong - here is where "castle doctrine" would come into play (776.013 Home protection; use of deadly force; presumption of fear of death or great bodily harm.)

"At this point you are not defending your property you are defending yourself, and you found yourself in this crapstorm while defending your property(and you do have the right to defend your property)."

i maintain that i'm not sure this is what the OP asked, but regardless i agree with you. beating down a would-be thief, assuming he poses no physical threat to you and is not trying to break into your home (in this case), is not protected under castle doctrine, as i interpret it. protecting yourself is another matter. again, please correct me if i'm wrong. i'm familiar with the reasonable person standard, and you've surely cleared up any questions i had with your first post so i'm not trying to get the arguement going again. but hopefully you can at least see where my questions came from. sorry for being rude or offending you. no excuse for that.

and for the record i was not trying to make your typo a big deal, just busting a little chops. we all make typos. who cares?

Do like I do, shoot 'em first then drag 'em to the next county and drop 'em of there.
