Any reason given as to why he won't give up the car and do you know for sure the car is truley there?

IF you have proper title in your hand, go knock on the door again. Take the previous owner with you.
If he refuses to allow you to take the car, call the cops right there while standing in front of the guy.
Your reporting a stolen car and the previous owner told you it was in this garage.

I was thinking, file a stolen auto report but explain where it is parked, but let the office give the guy a chance to let you remove it. If the Police will not handle it in this fashion, you might have to go the trouble of filing a "Break Order". I did one years ago, and it was a pain, time consuming and aggravating as hell, but I got my item back. By the way, is this a $500 hooptie or a 10k ride??????????? This actually made a difference in how it was handled in my case...........

The guy holding the car may have a lien on car for work that he did also.Will he give you a reason for holding the car?

To have a lien for work done, in florida, he would have to be a state registered Mechanic Shop. For a storage fee lien, in florida, he would have to be a registered towing company with an "approved" storage yard. I think this is pretty much accurate info.

If it makes any difference here, I think theft in Florida is defined as "prohibiting the use of item"
