Default Labor Law Question

If a company terminates an employee or eliminates their position, are they obligated to pay that employee for unused vacation or sick time? Thanks, Boo

They are NOT obligated to pay any sick or vacation time. Also if you have received any raises since starting, they only have to pay you your hours bases on what your starting rate was not what it is now. Been through it before.

Sniper is correct, they are not required to pay you for unused vacation/sick time. Most companies will, but it is not a requirement. (I know because the Company I work for doesn't pay for unused vacation, or unpaid Commissions earned). Our Company handbook says you must be an active employee to receive payment for holidays or commissions, once you are let go, you are no longer an active employee.

I'm in a union. I get pay for vacation, but not sick leave.

It all depends on the negoitated contract.

I hear a lot of complaints about unions but this is the kind of thing that makes unions look good. I'm a member of one also and we have the union negotiate our contract.

I'm union too, we earn our vaction the year before by working greater than 1080 hours. They pay our unused vacation within 30 days after leaving. If we have worked the 1080 hours and earned next years vacation, its paid too.

The law does not require an employer to pay out after termination in Fla. but it does require that they meet any contractual agreements...

Employee handbook, signed hire on papers etc... if they state in writing that these are equal to pay or YOURS... they must pay up...

If the papers ever state hours worked will equal hours of non worked payed time... they are over a barrel...

But I am the odd man out who refuses to honor a letter of "non compete" unless they have a receipt of a financial transaction buying my signature...

We are not in a slavery type setting so I do not have tohonor that silly thing without at least 9 months of pay... but I try for the whole year of pay.

The "Right to Work" setting in Fla. has alot of privileges for the worker as well as the employer...
