Default just foun ot the vehicle i bought was wrecked

came home today from work and the wife told me that the molding around the door had " fell off " . so i got to looking and sure fire the passenger side molding around the door had pulled off all the way around. i got to looking at the exposed metal and saw where some tac welds had pulled apart. came inside and did a carfax. sure enough the car had a right side impact, disabled and towed report. then the car was sent to auction,then my azz bought it from a big dealer in daphne. " the home of the life time warranty" place. i knew that i had bought a used vehicle, but i had no idea that i bought a wrecked vehicle. it was never disclosed to me that i bought a wrecked vehicle. am i stuck with a wrecked vehicle or can i take it back?

Dealerships have to disclose that a vehicle has been in an accident, I believe.

Unfortunately in Alabama they do not have to disclose it. They can even sell salvaged titled cars. I would try and see if they will make it right.

It was'nt a Green Kia Van was it? I traded ours in almost 2-months ago.. They told me they had to send it to auction since the rebuilt title,But someone would come from AL and Buy it take it back and get a clean title for it..

It would be fraud, if they told you it wasn't wrecked and knew it was. The only thing that might pertain to this is:
Section 8-20-4.1

Obligation to act in good faith and deal fairly.

Every dealer agreement entered into under Act 2010-198 shall impose on the parties the obligation to act in good faith and to deal fairly.
(Act 2010-198, p. 300, 2.)

thanks bro, i need that now. had to purchase at a time when a family member was dealing with cancer and needed that third row seating. we went to them and never dreamed that they would sell us a wrecked, and patched vehicle and not disclose it to us in the finance room. now my family member is gone and my vehicle is falling apart. oh well, thanks alot you big toyota dealer in baldwin county.
