The 10 day period is mandated by the health Dept. It's the exposure/bite quarantine period. If a domesticated animal is exposed to or exposes someone to the possibility of rabies, within ten days you will begin to see the signs. The quarantine period ensures that the animal is not possibly re-exposed to a virus while watching for the signs of rabies. It's simply a mandated precautionary time frame to protect the victim and the animal. And yes even animals vaccinated against the rabies virus can still become infected, hence the reason for the isolation.

Keep in mind, there is a major difference in provoked and unprovoked attacks. And this is where the charging of the animal & human determination comes from.

I had a golden retriever knock a lady down years ago. She was walking around the block and throwing a stick for the dog and it knocked her down, she went to the ER to be checked out. The husband came over and wanted me to pay the ER bill, I said OK.

I called my insurance company and they told me to pay the bill and they faxed over a release for him to sign. I called them up and asked them if they were going to pay me back the money I paid and they said no. I told them I wasn't going to pay anything and was going to tell the guy to just sue me. The insurance company backed waay off then and offered to pay all the lady's expenses but I never heard from her again.

What I was told by the insurance company is that in Florida, if your dog hurts someone it is just a matter of establishing the damages. I have no idea if that applies to your own property. That woman was walking down a public street.
