This law was written in 93, it was added to the CFR's as law after it passed. The section it is referring to is the one that Jim T posted. Before 93 I take it was illegal to split cost of gas I guess. I'm sure it all derived some some dumbass law suit.

The USCG just don't make up the rules. It has to be passed by congress and then they will institute it into the CFR's.

The CFR's are about 4-5 feet high and is very thin pages and very small writing. (This is just for boats and ships) I'm guessing Jim T. has to cipher through 6-8 feet of CFR's dealing with the airline/Transportation industry.

All these captains which are raising a stick on here about this rule needs to give this subject a rest. It's in Black and White and the laws have been posted for you to read. Me taking out some folks I don't know and charging them $20 apiece for gas is not gonna kill them. I caught shit two years ago when I posted about taking folks out for $10 or $20 a person and it was a shit storm. That's why I posted the actual law as it was passed and Jim T posted it's incorporation into the CFR's.

The OP wanted something in black and white and now he has it two ways, The actual law as it was passed by congress and where it is in the CFR that he can quote.

Now some more info. NO... the CFR's are not gonna be clear because some lawyer wrote them. I'm also with Jim T. want constitutes voyage costs? Do I divide the Ins. payment by day or the whole month if I only fish 1 day a month. Same for my boat payment. What about my gas to drive to the boat. Oil used, Toilet Sanitizer, and hours used on engines before have to take it in and have the 100 maintenance done. It is never ending but why push it. Charters count all those costs into their price so why not the Rec. guy????

So you ask, are their any updates? The answer is NO... The law passed in 1993 is still in effect as it was written then.

More explanation, you notice how it says Part 2101 of title 46, United States Code, is amended by inserting between paragraphs (5) and (6) a new paragraph (5a) to read as Follows:

If you notice the brochure Jim T. posted it is definitions under 46 US Code (USC) 2101. If you look at the link below you will see that a new paragraph (5a) has been inserted between 5 & 6. This wasn't there I'm guessing prior to 1993.

Seems like it wouldn't be an issue until one of your "friends" got hurt and the FWC\ USCG\ etc started looking into the circumstances of the accident. As soon as your "friend" implies that he is a customer then the gig is up. Nice big ticket, no insurance coverage, etc....
