Default Licensed for X number of passengers...

We have booked a charter for this summer and learned that the vessel although larger than most charters we have taken is licensed for only 6 passenegers (with 3 crew members).

We are planning a big trip that will be overnite and approach 24 hours. The problem is that at 6 we would have to leave someone at home

i understand rules are rules so I am not asking how to break them but given the boat has capacity for more passengers are any of the following options possible?

1) Pay for the captain to get a temp license to carry more tha 6
2) Offer to pay any fines if the Coast Guard should pull us over..

I appreciate the insight in advance as we really want to go with this crew but don't want to leave anyone off the trip.

I'd call the captain and explain your predicament.

Option 2 will get you and the captain into a lot of trouble.

Did you know this before you booked? Did the captain know that you were bringing more than 6 people?

Haven't officially booked. If I had i would just deal with it. But I really like the crew and would like to make this work.

He can't legally take more than 6 paying customers because his boat and or license isn't for more than 6 people.

I understand that and I think I alluded to the fact that i wasn't asking how to break the law in my original post.

But like anyhting else in life there are ways to "make things happen" as I suggested paying for a temproary or seasonal increase in the pax limit #.

Can this be done? Obviously some baots can carry more than six - correct??

It's not a seasonal license deal. It has to do with his Captains license. He most likely only has 6-pack license, so unless he get's a 100 ton he can only take 6 passengers regardless of how big his boat is. So unless you want to spend 3 grand sending him to sea school it's not really an option.

He may have another Captain that is lisenced to fish more passengers, or you will just have to fish another boat or only 6 guys.

They MIGHT go with only one deckhand and just call one of your guys a crew member, but I doubt it.

The best bet would be for the Captain to get another Captain that has a license larger than a six pack to ride along as a deckhand. This probably wont be hard to work out. I know plenty of 50-100 ton captains that wouldn't mind playing deckhand for a couple days.

Yeah I'm sure he knows a 100ton captain that could ride along, just explain the situation before hand and see what he says.

Like I stated before the boat must be certified for more than 6 passengers. Any boat big enough can take up to 6 pass. Without being inspected. With a licensed capt.

More than 6 MUST be inspected AND have properly licensed capt. No such thing as an exception...
